This Privacy Policy explains how Flatfiv LLC, an Arizona limited liability company ("Flatfiv," "we," or "us"), collects, uses, and shares personal information when you use the online marketplace operated by Flatfiv, including its websites and related services (the "Marketplace"). Capitalized terms that are not defined here, such as "Product" and "Creator," have the meanings given in our Terms of Service.
1. Information We Collect
1.1 We collect the following categories of personal information:

| Device and usage information | Your IP address, browser and device type, the pages you visit, and the dates and times of your visits. This is collected automatically when you use the Marketplace. |
| Communications | The messages you send us, such as support requests and refund requests. |
| Creator applications | Your name, email address, website or social media links, and your description of what you would like to sell. You provide this when you apply to sell on the Marketplace. |
| Creator payout and tax information | Payout details and tax forms, such as Form W-9. Creators provide this to us or to our payout provider before receiving payments. |
1.2 Your full card number goes directly to Stripe. We never receive or store it.
2. How We Use Information
We use personal information to:
- (a) create and secure your account, including by sending sign-in codes;
- (b) process purchases, deliver Products, and send receipts;
- (c) provide customer support and process refunds;
- (d) calculate and collect taxes, keep financial records, and pay Creators;
- (e) review applications from Creators;
- (f) operate, maintain, and improve the Marketplace, including search;
- (g) send you news about new Products and features, unless you opt out;
- (h) prevent fraud, abuse, and security incidents; and
- (i) comply with legal obligations and enforce our Terms of Service.
3. How We Share Information
3.1 We share personal information only as described in this Section 3.
3.2 When you buy a Product, we share your name and email address with its Creator so that they can stay in touch with you. For downloadable Products, such as sample packs, presets, and sheet music, the Creator also sees which of their Products you bought and when. For video courses, you may opt out of this sharing at checkout. If you do not opt out, the Creator receives your name and email address and sees that you bought a course from them, but not which course. Creators must use this information only to communicate with you about themselves and their work, must honor your requests to unsubscribe, and may not sell it. You may ask us at any time to stop sharing your information with a Creator by emailing contact@flatfiv.com. We will then stop sharing it and ask the Creator to delete it.
3.3 We share information with service providers that help us run the Marketplace, such as our hosting provider, our payment processor, our video and file delivery providers, our email delivery provider, and our payout provider. They may use it only to provide services to us.
3.4 We may share information when we believe in good faith that the law requires it, or when it is necessary to protect the rights, property, or safety of Flatfiv, Creators, our users, or others, including to prevent fraud.
3.5 If Flatfiv is involved in a merger, acquisition, or sale of all or part of its business, personal information may be transferred to the new owner, who will be bound by this Privacy Policy.
3.6 We do not sell your personal information. We do not share information about the Products or videos you buy or watch with advertising networks or social media platforms.
4. Cookies and Similar Technologies
4.1 We use cookies and similar technologies only as needed to run the Marketplace, such as to keep you signed in, to protect forms against forgery, and to remember your preferences and course progress. We do not use advertising cookies, and we do not allow third-party advertising trackers on the Marketplace.
4.2 Our pages load fonts, scripts, and video players from third-party providers, which receive your IP address and browser information when your browser requests them. Stripe may use cookies on its checkout pages to prevent fraud, under its own privacy policy.
4.3 If we add website analytics, we will use a service that does not track you across other websites, and we will update this Privacy Policy first. Because we do not track you across other websites, our practices are the same whether or not your browser sends a Do Not Track or Global Privacy Control signal.
5. Emails From Us
5.1 We send transactional emails, such as sign-in codes, receipts, and important notices about your account or purchases. You cannot opt out of these while you have an account.
5.2 We may also send emails about new Products and features. Every one of those emails includes an unsubscribe link, and unsubscribing does not affect your purchases.
6. Data Retention
We keep personal information only for as long as we need it for the purposes described in this Privacy Policy:
- (a) sign-in codes expire 10 minutes after they are sent and are routinely deleted afterward;
- (b) account information is kept while your account is active;
- (c) purchase and financial records are kept for as long as tax and accounting laws require, generally 7 years;
- (d) creator application materials are kept while we review an application and for as long as the Creator sells on the Marketplace; and
- (e) server logs are kept for a limited period for security and troubleshooting.
7. Security
We protect personal information with measures such as encrypted connections, hashed sign-in codes, and limited access to our systems. Payment card information is handled by Stripe. No method of transmission or storage is completely secure, so we cannot guarantee absolute security.
8. Your Choices and Rights
8.1 You may ask us to:
- (a) tell you what personal information we hold about you and provide a copy of it;
- (b) correct information that is inaccurate;
- (c) delete your personal information;
- (d) stop sharing your information with a Creator; or
- (e) stop sending you marketing emails.
8.2 To make a request, email contact@flatfiv.com from the email address on your account, so that we can verify your identity. We will respond within 30 days. Deleting your account ends your access to your Products, and we keep records that the law requires us to keep, such as purchase records for tax purposes.
8.3 Depending on where you live, including California, other US states, the European Union, and the United Kingdom, you may have additional rights under local law. We honor the requests described in this section from all users, wherever they live, and we will not treat you differently for making one. If we decline your request, you may appeal by replying to our decision, and we will respond to your appeal within 45 days.
9. Users Outside the United States
9.1 Flatfiv is based in the United States, and we process and store personal information in the United States. If you use the Marketplace from outside the United States, your information will be transferred to the United States. Where the law requires it, we rely on appropriate safeguards for these transfers.
9.2 If the laws of the European Union or the United Kingdom apply to you, we process your personal information on the following legal bases:
- (a) to perform our contract with you, such as processing purchases and delivering Products;
- (b) to comply with legal obligations, such as tax and accounting laws;
- (c) for our legitimate interests, such as securing and improving the Marketplace, telling existing customers about similar Products, and connecting buyers with the Creators whose Products they buy; and
- (d) with your consent, where we ask for it.
9.3 You may also lodge a complaint with your local data protection authority.
10. Children
The Marketplace is not directed to children under 13, and we do not knowingly collect personal information from them. If we learn that we have collected personal information from a child under 13, we will delete it. Users between 13 and 17 may use the Marketplace only with a parent's or guardian's permission, as described in our Terms of Service.
11. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. We will post the updated version on this page with a new "Last updated" date, and if we make material changes, we will notify you by email or through the Marketplace before they take effect.
